If you are planning to sell a property in Mazarrón, Puerto de Mazarrón or elsewhere in the Region of Murcia, preparing the documents in advance can prevent unnecessary delays once a buyer is found.
A property may already have an interested buyer but still be unable to proceed smoothly if an important certificate is missing, an old mortgage remains registered or the cadastral information does not match the property's legal documentation.
For this reason, PROSER recommends reviewing the paperwork before the property is placed on the market, rather than waiting until completion is approaching.
Main documents you should prepare before selling
✓ Passport, DNI or NIE

✓ Up-to-date Land Registry information
✓ Latest IBI bill and cadastral reference

1. Identification documents
All owners involved in the sale must be properly identified.
Depending on the circumstances, this may include:
- DNI for Spanish owners;
- NIE and passport or national ID for foreign owners;
- company documentation where a company owns the property;
- a valid power of attorney where a representative signs on behalf of the seller.
It is also advisable to make sure that the owner's identification details correspond correctly with the information held at the Land Registry.
2. Title deed
The title deed shows how the current owner acquired the property and contains important information about the home.
However, an old deed does not necessarily show the property's current legal position. For this reason, current Land Registry information should also be checked.
3. Land Registry information
An up-to-date nota simple from the Spanish Land Registry can show:
- the registered owner;
- the registered description of the property;
- mortgages;
- embargoes;
- usufruct rights;
- easements;
- and other registered limitations or charges.
Checking this information early makes it possible to identify issues before the property reaches the reservation, deposit contract or completion stage.
It is not unusual to find a mortgage that was paid off years ago but was never formally removed from the Land Registry.
Finding this out early gives the seller time to arrange its cancellation before completion.
4. IBI receipt and cadastral reference
The seller should have the latest information relating to the Spanish local property tax, known as IBI.
The latest IBI bill will normally also contain the property's cadastral reference.
This reference uniquely identifies the property in the Spanish Cadastre and helps compare:
- the physical property;
- cadastral information;
- the title deed;
- and Land Registry information.
Significant differences in areas, extensions or buildings may need to be investigated before the sale takes place.
5. Energy Performance Certificate
As a general rule, existing properties offered for sale in Spain must have a valid Energy Performance Certificate, unless a legal exemption applies.
Energy efficiency information must also be included in property advertising where the certification requirement applies.
When the property is sold, the registered certificate must be made available as part of the transaction.
Where an Energy Performance Certificate is required, arranging it before marketing begins allows the property to be advertised correctly from the start.
6. Community of owners certificate
Where the property belongs to a community of owners, the seller must state whether community fees are fully paid or whether any amount remains outstanding.
A certificate showing the property's debt status with the community is normally required for completion unless the buyer expressly releases the seller from the obligation to provide it.
It is therefore advisable to request the certificate early enough for completion.
7. What if there is an outstanding mortgage?
Having an outstanding mortgage does not prevent a property from being sold.
However, you should establish:
- which bank holds the mortgage;
- the outstanding balance;
- the amount required to repay the loan on the expected completion date;
- and how the mortgage will subsequently be removed from the Land Registry.
Where the loan has already been repaid but the charge remains registered, a formal Land Registry cancellation may still be necessary.
8. Documents for international property owners
Mazarrón and the surrounding coast have a significant number of international and non-resident property owners.
Depending on the circumstances, it may be advisable to prepare:
- NIE;
- passport or national ID;
- Spanish tax information;
- bank account details;
- a Spanish power of attorney if the seller cannot travel;
- and documentation needed for the tax aspects of the transaction.
Preparing these matters before a buyer is found can make the sale considerably easier.
9. Do I need an occupancy licence or habitability certificate?
This should be reviewed on an individual basis.
The planning and occupancy documentation required may depend on the property's age, location, type and legal circumstances.
In some transactions it may also be necessary to review:
- planning licences;
- declarations of new construction;
- extensions;
- swimming pools;
- enclosures;
- alterations;
- or differences between the physical property, Cadastre and Land Registry.
When should the paperwork be reviewed?
Before marketing
Check ownership, charges, cadastral information, the energy certificate and any potential legal or technical issues.
When a buyer is found
Update any documents with limited validity and prepare the information needed for the reservation or deposit contract.
Before completion at the notary
Check the community certificate, mortgage status, IBI, payment arrangements and any documentation requested by the notary.

Do not wait until you have a buyer before looking for the paperwork. An early review can reveal an old mortgage, a floor-area discrepancy or a missing certificate and gives you time to solve the issue before it threatens the sale.
